Terms and conditions of the Madak app

Welcome to the MADAC app (“MADAC”, “we”, “the app”). By using or registering for our app, you agree to abide by these terms and conditions, along with our privacy policy, cookie notice and major risk document. If you do not agree to any part of these terms, you should stop using the app immediately.

This application is operated by Madak Information Technology Company, Commercial Registration No. 1009121789, Riyadh, Kingdom of Saudi Arabia. Madak has the right to manage and operate the services provided through the application, including providing investment opportunities in real estate through special purpose companies (SPV) managed by MADAC or parties authorized by it, in accordance with the relevant Saudi and UAE regulations.

We reserve the right to amend these terms at any time for organizational, operational, or legal reasons. Amendments become effective immediately after they are posted on the app. Your continued use of the app after the modifications means you agree to them.

2. tariffs
- User: Any natural or legal person who uses the application, whether as an investor or as a seller.
- Investor: A person who participates in investment opportunities through the app.
- Real estate opportunities: real estate or real estate shares offered for investment through MADAC.
- Secondary market: the service of reselling shares available through the app periodically.
- Special Purpose Company (SPV): the legal entity that owns the property being invested.

3. Scope of application and services
The Madak app provides users with the ability to:
- Review investment opportunities in income-generating real estate.
- Participation in the financing of collective ownership of real estate through SPV companies.
- Take advantage of the secondary market to resell quotas monthly.

The app does not provide any personal investment advice, and all information provided is for informational purposes only.

4. Eligibility and registration
For use you should:
- You have completed 18 years of age and have full legal capacity.
- You provide correct and current information during registration, and you are committed to updating it.
- You agree to submit the required documents (proof of identity, proof of address) in accordance with the obligations of combating money laundering and terrorist financing.

We reserve the right to reject or suspend any registration request at our sole discretion.

5. Users' obligations
The user is prohibited from:
- Providing incorrect data.
- Violation of any applicable laws or regulations in the Kingdom of Saudi Arabia or the United Arab Emirates.
- Using the app for any illegal or fraudulent purposes.

6. Prohibited uses
You may not:
- Upload or post any illegal or offensive content.
- Attempting to gain unauthorized access to the app or user data.
- Using any tools or robots to extract data or interfere with the operation of the application.

7. The nature of the services and the non-provision of consultations
Madak does not provide any financial recommendations or advice. Any revenue estimates or future projections are indicative only, and actual results may vary.

8. The secondary market
The app allows the resale of shares through the secondary market in accordance with the conditions announced within the app. Madak does not guarantee immediate liquidity or specific resale prices.

9. The main risks
- The capital is not guaranteed.
- You may lose your entire investment.
- Past performance does not guarantee future results.
- You may have difficulty exiting or reselling shares.

We recommend that you consult an independent financial advisor before making any investment decision.

10. intellectual property rights
All rights related to content, designs, icons, and logos are owned by Madak. No part of the app may be reproduced without written permission.

11. Limitation of liability and compensation
- The maximum liability of Madak towards any user does not exceed 5,000 Saudi Riyals.
- We are not responsible for any indirect or consequential damages or loss of profits.

12. Account termination
Madak has the right to suspend or cancel your account at any time if you violate these terms or for any legal reason.

13. Law and Jurisdiction
These terms are governed by the laws of the Kingdom of Saudi Arabia, with reference to their compatibility with the regulatory frameworks in the United Arab Emirates. The jurisdiction of the Saudi courts shall be.
